By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy and Data Protection Notice (collectively, the “Agreements”). If you do not agree to the Agreements, you must stop using the Service.

HeyAmos provides AI-powered visibility, analytics, and insights software delivered as software-as-a-service (“SaaS”). We may update, modify, improve, or discontinue any part of the Service at any time.
We do not guarantee any commercial, performance, ranking, or visibility outcomes resulting from the use of the Service.
To use certain features, you may need to create an account. You agree to:
a. provide accurate and up-to-date information,
b. maintain the security of your login credentials, and
c. accept responsibility for all activities under your account.
You must notify us immediately of any unauthorized access or security breach.
You agree not to, and will not permit others to:
a. use the Service for unlawful, harmful, or fraudulent purposes;
b. copy, modify, reverse-engineer, or create derivative works of the Service;
c. access the Service in a way that overloads or interferes with system performance;
d. scrape, extract, or misuse data or outputs except as permitted by the platform;
e. attempt to gain unauthorized access to the Service or related systems.
Violation of this section may result in immediate suspension or termination.
All software, dashboards, data models, content, trademarks, and technology associated with the Service are owned exclusively by the Company.
You receive a limited, revocable, non-exclusive, non-transferable license to access and use the Service solely for your internal business purposes.
Nothing in these Terms grants ownership rights or allows redistribution, resale, white-labeling, or reproduction of the Service.
We aim to provide reliable access but do not guarantee uninterrupted or error-free operation. The Service may be unavailable due to maintenance, upgrades, or unexpected issues.
We are not liable for any downtime, data delays, or resulting loss of business opportunity.
The Service may integrate with third-party tools (e.g., analytics, hosting, AI models). We are not responsible for the practices, performance, or content of these third-party services.
Your use of third-party tools is governed by their respective terms.
Each party is responsible for complying with applicable data protection laws.
If you are accessing through an agency or reseller:Your commercial relationship (including billing and support) is with that partner, not HeyAmos. We provide the technical platform only and do not assume any commercial obligations between you and your agency partner.
Account creation: Platform accounts may be created directly by you or provisioned by an authorized agency or reseller partner on your behalf.

We do not act as a data processor for agencies or third parties unless expressly agreed in writing.
If you subscribe to a paid plan directly:
a. you authorize us to charge you according to the plan selected;
b. fees are non-refundable except as required by law;
c. we may revise pricing with prior notice;
d. your subscription renews automatically unless cancelled.
Failure to pay may result in suspension or termination.
If you are accessing the Service through an agency or reseller partner, billing and payment are handled by that partner according to your agreement with them. HeyAmos invoices the agency partner, not you directly.
To the fullest extent permitted by law:
a. The Company will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, visibility, ranking, data, reputation, or business.
b. The Company’s total liability for any claim will not exceed the amount paid by you to the Company in the past three (3) months.
You understand the Service provides insights and analytics only and does not guarantee outcomes.
The Service is provided “as is” and “as available.”
We disclaim all warranties, whether express or implied, including:
merchantability,
fitness for a particular purpose,
non-infringement,
accuracy or reliability of insights or outputs.
We may suspend or terminate your access immediately if you:
a. violate these Terms,
b. engage in unlawful or harmful behavior,
c. misuse the Service, intentionally or otherwise.
Upon termination, your right to use the Service ceases immediately. We may retain information as required for compliance and business records.
We may update these Terms from time to time.
We will notify users of material changes via email or through the Service.
Continued use after changes indicates your acceptance of the updated Terms.
These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles.
Any disputes shall be resolved in Singapore courts.
